PROPOSED MINUTES

FERNDALE CITY COUNCIL MEETING

MONDAY, APRIL 14, 2003, 7:30 P.M. AT CITY HALL

A Regular Meeting of the Ferndale City Council was held Monday, April 14, 2003, at City Hall, 300 East Nine Mile Road, Ferndale. Mayor Porter called the meeting to order at 7:35 p.m.

Mayor Porter led the Pledge of Allegiance.

Roll call showed the following members of Council present: Council Members Covey, Galloway, Lennon, Weber; Mayor Porter. Absent: None.

XXX. Mayor Porter requested a moment of silence for the fallen service men and women who served during Operation Iraqi Freedom and for 147 Police Officers who died in the line of duty during 2002.

XXX. Call to Audience

1. Dave Coulter, County Commissioner, updated Council regarding upgrading election equipment.

2. Frank Flores, American Legion Post No. 330, read a statement to request everyone to support the troops and announced on April 16, 2003, at 7:00 p.m., at Oak Park Community Center, a support group meeting would be held for those with family members involved in the war.

3. Brian Cooley, member of Beautification Commission, announced that the Parks Clean-Up will be on April 26, 2003 at 9:00 a.m. and still needed volunteers and also announced the Commission was seeking nominations for the "Great Tree" contest.

Consent Agenda

XXX. It was the consensus of Council that Consent Agenda Items 4B and 4F be considered after the Regular Agenda.

Moved by Councilman Covey, seconded by Councilman Galloway, to approve the amended Consent Agenda as follows:

A. Approval of transfer of 2002 Class C Liquor License with Dance-Entertainment Permit located in escrow at 22061 Woodward from The Body Shop Boys, L.L.C. to Posh Entertainment, Inc., as submitted by Police Chief.

B. REMOVED FROM CONSENT-MOVED TO END OF REGULAR AGENDA

C. Approval of Special Event Application from American Postal Union 480-481 Area Local for an annual picnic on Sunday, July 27, 2003, from 12 Noon to 8:00 p.m., at Martin Road Park, as submitted by City Clerk.

D. Memorial Day Parade - May 26, 2003, as submitted by City Manager.

1. Approval of observance of Memorial Day with annual parade

2. Approval of contribution to Ferndale Memorial Association

3. Approval of agreement with Ferndale Memorial Association and authorization for the Mayor to sign agreement

4. Adoption of Resolution authorizing City Clerk to apply to MDOT for permit

E. Approval of purchase of Automated External Defibrillator and carrying case, from Philips Medical Systems, as submitted by DPW Director.

F. REMOVED FROM CONSENT-MOVED TO END OF REGULAR AGENDA

G. Approval of Sidewalk Cafe License Agreements for Xhedos Cafe, Java Hut Cafe, Assaggi Mediterranean Bistro, Woodward Avenue Brewers, LeSoups and Starving Artist Cafe (with contingency for Starving Artist Cafe) and authorization for the Mayor and City Clerk to sign agreements, as submitted by CDS Director.

H. Receive the Fire Department Report for February, 2003.

I. Approval of the bills, payrolls (as certified by City Manager) and City Attorney expense statement submitted by Howard Shifman, P.C. and Beier Howlett, P.C., to be paid subject to review by the Council Finance Committee.

XXX. Moved by Councilman Galloway, seconded by Councilwoman Weber, to appoint Blair Simmons, 736 W. Breckenridge, as a Democrat Representative, to fill the unexpired term, expiring December 31, 2005.

B. Consideration of adoption of Resolutions saluting Ferndale Youth Recognition Awards recipients

XXX. Moved by Councilman Covey, unanimously supported, to adopt Resolutions saluting Ferndale Youth Recognition Awards recipients.

C. Consideration of adoption of Resolution regarding SEMCOG review and recertification

XXX. Moved by Councilman Galloway, seconded by Councilman Lennon, to adopt the Resolution opposing SEMCOG review and recertification.

D. Consideration to fill Police Officer position

XXX. Moved by Councilman Galloway, seconded by Councilwoman Weber, to table the consideration to fill the Police Officer position until the May 12, 2003 Regular Council Meeting.

G. Consideration to receive FYE 2004 Draft Budget and schedule Public Hearing

Councilman Covey left Council Chambers at 8:50 p.m.

Councilman Covey returned to Council Chambers at 8:52 p.m.

XXX. Moved by Councilman Galloway, seconded by Councilman Covey, to receive the FYE 2004 Draft Budget and schedule the Public Hearing on the Proposed FYE Budget for Monday, April 28, 2003 at 7:30 p.m.

H. Consideration to award bid for emergency water main work

I. Consideration of adoption of Ordinance No. 962, an amendment to the Zoning Ordinance, regarding rezoning of 1844 Almont from P-2 District to R-1B District

Mayor Porter left Council Chambers at 9:01 p.m.

Councilman Galloway assumed the Chair at 9:01 p.m.

Mayor Porter returned to Council Chambers at 9:04 p.m.

XXX. Moved by Councilman Lennon, seconded by Councilman Covey, to adopt Ordinance No. 962, an amendment to the Zoning Ordinance, regarding rezoning of 1844 Almont from P-2 District to R-1B District.

Call to Council

XXX. Fire Chief LeGault announced that retired Firefighter Engineer Gordon Armitage had passed away. He also announced that Pleasant Ridge had given him dates for the Contract Committee to discuss the Fire Protection Contract with them. Councilman Covey inquired about the Fire Union feelings of not being notified of any information on potential fire protection for Royal Oak Township.

Mayor Porter left Council Chambers at 9:29 p.m.

Councilman Galloway assumed the Chair at 9:29 p.m.

Mayor Porter returned to Council Chambers at 9:34 p.m.

XXX. City Manager Barwin announced that the Withington Parking Lot will be resurfaced in May. He also announced that the group involved in expanding the Intermodal Freight Facility will be holding their next meeting in Ferndale in late April and the Integrated Pest Management Committee will bring recommendations at the next Council Meeting.

XXX. Councilman Lennon announced he attended a meeting regarding Instant Runoff Voting. He also announced that he received an e-mail from a resident regarding rezoning in the area near the 8 Mile/Woodward Bridge.

XXX. Councilman Galloway announced that children’s programming will be held at the Ferndale Activity Center (Curling Club) during the summer and commented about his experience at the MML Conference.

XXX. Councilwoman Weber announced that Pak Mail would be hosting a Grand Opening celebration on April 24, 2003 from 4:00 p.m. to 7:00 p.m. and commented on information distributed in the Chambers which gives assistance to residents and communities to look at federal policies and budget concerns.

XXX. Councilman Covey announced that the Star of India Restaurant was open and that the new club Posch would be open by summer. M.A.P.P. would be hosting a fund-raiser, "Salsa 2003" at Wednesday, May 7, 2003 at Boogie Fever to see which local restaurant has the best salsa.

XXX. Mayor Porter announced that 147 police officer died in 2002, in the line of duty. He also requested residents to keep the flyer they received from the Department of Public Works recently as a reference throughout the year.

Mayor Porter adjourned the meeting at 9:50 p.m.
