FERNDALE CITY COUNCIL MEETING
MONDAY, JUNE 9, 2003, 7:30 P.M. AT CITY HALL

A Regular Meeting of the Ferndale City Council was held Monday, June 9, 2003, at City Hall, 300 East Nine Mile Road, Ferndale. Mayor Porter called the meeting to order at 7:35 p.m.

Mayor Porter led the Pledge of Allegiance.

Roll call showed the following members of Council present: Council Members Covey, Galloway, Weber; Mayor Porter. Absent: None.

Mayor Porter inquired if any members of Council objected to modifying the Agenda. No Council members indicated objection.

Mayor Porter commented about Councilman David A. Lennon and read the Irish Blessing. He also requested a moment of silence.

XXX. Moved by Councilman Galloway, supported unanimously, a condolence Resolution for Councilman David A. Lennon.

Councilman Galloway commented on Councilman Lennon.

Councilwoman Weber read a Resolution from State Representative Andy Meisner for Councilman Lennon, which is proposed to be adopted by the State House.

Councilwoman Weber commented on Councilman Lennon.

7:42 p.m. Councilman Covey left Council Chambers

7:49 p.m. Councilman Covey returned to Council Chambers

XXX. PRESENTATION Integrated Pest Management Committee update on West Nile Virus

Patrick Dengate, Sue Lindon, Joe Trice and Jon Nettle, members of the Integrated Pest Management Committee, provided an information on the West Nile Virus.

XXX. Call to Audience

1. Erick Buchholz expressed concern regarding music sound levels during "Thursday on the Nine"

2. County Commissioner Dave Coulter expressed condolences for Councilman Lennon; commented on Ferndale’s innovative pest management plan and announced that Oakland County Commissioners did not pass his plan to have some meetings at evening hours.

3. Dawn Ptaszynski inquired about the status of her request regarding the Council’s budget for donations and inquired about who placed the rainbow flags in the downtown and when will they be removed.

4. K.C. Vansen announced that the Ferndale Garden Tour would be held on Saturday, June 14, 2003.

5. Pat Cissell expressed condolences for Councilman Lennon and commented that the holiday display should be returned to City Hall.

6. Steve Lawrence expressed condolences for Councilman Lennon and requested information on revenue from the past year from false alarm fees.

Consent Agenda

XXX. It was the consensus of Council that Consent Agenda Item 5I be considered after the Regular Agenda.

Moved by Councilwoman Weber, seconded by Councilman Galloway, to approve the amended Consent Agenda as follows:

A. Approval of the Minutes of the Special Meetings held March 24 and April 8, 2003, as submitted by City Clerk.

B. Approval of the Special Event Application from the Ferndale Garden Club to hold a Garden Tour in Northwest and Southwest Ferndale on Saturday, June 14, 2003, from 11:00 a.m. to 5:00 p.m., as submitted by City Clerk.

C. Approval of Special Event Application from Edison Oakland Public School Academy for South America House Field Day on Friday, June 20, 2003, at Wilson Park, as submitted by City Clerk.

D. Approval of Special Event Application from Edison Oakland Public School Academy for Parent Appreciation Day on Wednesday, June 25, 2003, at Wilson Park, as submitted by City Clerk.

E. Approval of Special Event Application from Edison Oakland Public School Academy for North America House Field Day on Wednesday, June 18, 2003, at Wilson Park, as submitted by City Clerk.

F. Approval of agreement with Oakland County Road Commission to re-time City traffic signals and authorization for the Mayor and City Clerk to sign the agreement, as submitted by DPW Director.

G. Approval of the quote from Athletica to reinstall dasher boards and protective fencing at Harding Park, as submitted by DPW Director.

H. Approval of Sidewalk Cafe License Agreement for Angel’s Cafe and authorization for the Mayor and City Clerk to sign Agreement, as submitted by CDS Director.

I. REMOVED FROM CONSENT-MOVED TO END OF REGULAR AGENDA

A. Consideration to fill Clerk/Typist II position, CDS Department

XXX. Moved by Councilman Covey, seconded by Councilwoman Weber, to approve the filling of the budgeted and vacant Clerk/Typist II in the CDS Department.

B. Appointment to the Housing Commission

XXX. Moved by Councilman Galloway, seconded by Councilman Covey, to appoint Carole Ann Morency, 415 Withington, Apt. 308 to the Ferndale Housing Commission for a five year term, expiring May 5, 2008.

C. Consideration of concerns submitted by residents regarding Pridefest

XXX. Erick Buchholz and Margaret McGuinness expressed concerns regarding Pridefest.

D. Consideration of adoption of Ordinance No. 969, which amends Chapter 21 of the Code of Ordinances, regarding Vehicles for Hire

XXX. Moved by Councilman Galloway, seconded by Councilman Covey, to adopt Ordinance No. 969, which amends Chapter 21 of the Code of Ordinances, regarding Vehicles for Hire as referred to the Council by the Ordinance Committee.

E. Consideration of Subordination Agreement with Stanley Building Company regarding 366 E. Webster and 265 E. Chesterfield

XXX. Moved by Councilwoman Weber, seconded by Councilman Galloway, to table definitely until the next Regular Council Meeting of June 23, 2003, the Subordination Agreement with Stanley Building Company regarding 366 E. Webster and 265 E. Chesterfield.

F. Consideration of a carnival to be held in conjunction with the Ferndale Car Show and related street closings

XXX. Moved by Councilman Galloway, seconded by Councilwoman Weber, to authorize the Ferndale Dream Cruise Car Show to engage in negotiations with Mid America Shows for a carnival to be held August 15 and 16, 2003; for any proposed contract submitted to our City Attorney for review and possible approval by Council at a later meeting.

Consent Agenda Item I- Approval of the bills, payrolls (as certified by City Manager) and City Attorney expense statement submitted by Howard Shifman, P.C., and Beier Howlett, P.C., to be paid subject to review by the Council Finance Committee.

Call to Council

XXX. Police Chief Kitchen, on behalf of the Police Department, were honored to be a part of Councilman Lennon funeral and expressed condolences to the family.

XXX. Fire Chief LeGault expressed condolences, on behalf of the Fire Department, to the Lennon family.

XXX. City Clerk Pedro expressed condolences to the Lennon family and to the Ferndale Community on the loss of Councilman Lennon.

XXX. City Attorney Christ expressed condolences to the Lennon family, City of Ferndale and to the Council for the loss of Councilman Lennon.

XXX. City Manager Barwin thanked those who expressed their memories and condolences regarding Councilman Lennon and will forward it to the family.

XXX. Councilman Galloway expressed condolences to the Lennon family.

XXX. Councilwoman Weber expressed condolences to the Lennon family.

XXX. Councilman Covey expressed condolences to the Lennon family and discussed his relationship with Councilman Lennon. Councilman Covey thanked the Police Department for the support and the Mayor for his support during this time.

XXX. Mayor Porter expressed condolences to the Lennon family and announced that the Ferndale Baseball Team won their Division and is moving on to the Championship Series for the first time in 10 years. Mayor Porter read a statement regarding David Lennon.

Mayor Porter adjourned the meeting at 10:03 p.m.
