FERNDALE CITY COUNCIL MEETING
MONDAY, JULY 28, 2003, 7:30 P.M. AT CITY HALL

A Regular Meeting of the Ferndale City Council was held Monday, July 28, 2003, at City Hall, 300 East Nine Mile Road, Ferndale. Mayor Porter called the meeting to order at 7:31 p.m.

Mayor Porter led the Pledge of Allegiance.

Roll call showed the following members of Council present: Council Members Covey, Galloway, Trice, Weber; Mayor Porter. Absent: None.

PRESENTATION July, 2003 Beautification Awards

XXX. Chuck Simon, member of the Beautification Commission, and Mayor Porter presented the July, 2003 Beautification Awards.

4. PRESENTATION Instant Runoff Voting (IRV) Video

XXX. A video was shown regarding Instant Runoff Voting (IRV)

A. Consideration of Resolution regarding Instant Runoff Voting (IRV)

Moved by Councilman Covey, seconded by Councilman Galloway, to adopt the Resolution as written by Councilman Galloway, with insertion of the paragraph after the 6th paragraph that says "IRV saves taxpayers significance sums by eliminating the need for a primary to reduce the number of candidates; and" supporting Instant Runoff Voting (IRV).

PUBLIC HEARING Special Land Use for the property located at 2421 Wolcott

XXX. Mayor Porter opened the Public Hearing at 8:13 p.m. Mike Socha and Jim Carrier, partners in the Naturalists Horticultural Services had questions and/or comments. Mayor Porter closed the Public Hearing at 8:15 p.m.

A. Consideration of Special Land Use Resolution

Moved by Councilman Covey, seconded by Councilman Galloway, that a Public Hearing was held the following Resolution approving the Special Land Use Application submitted the Naturalists Horticultural Services for outdoor storage at 2421 Wolcott be adopted.

XXX. Call to Audience

1. Stella Dyachenko commented on fence debris concerns.

2. Jean Davis, Chair of the Arts and Cultural Commission provided information on the up coming Art Fair.

3. Sally Sawyers expressed concern regarding house and grass conditions at a house on Jewell.

4. Frank Castronova expressed concern regarding conditions at neighboring houses and the speed of traffic on West Troy.

5. Gaye Tischler commented on numerous animals at a house on West Troy.

6. Jackie Koivu announced that the Free Press honored Frank O’Donnell as volunteer of the week; congratulate the Pub Crawl Committee for a successful event and invited everyone to Zion Lutheran Church Vacation Bible School this week.

7. Pat Cissell commented on plaque of the Police Officers at the Police Department.

Consent Agenda

XXX. It was the consensus of Council that Consent Agenda Item 7D be considered after the Regular Agenda.

Moved by Councilman Trice, seconded by Councilman Covey, to approve the amended Consent Agenda as follows:

A. Approval of the Minutes of the Special Meetings held April 30, May 6,

May 27, June 9, June 23, 2003, and the Regular Meetings held May 12,

May 27, and June 9, 2003, as submitted by City Clerk.

B. Approval of the Special Event Application from Linda Vish for a Commitment Ceremony on Saturday, September 6, 2003, at Martin Road Park, as submitted by City Clerk.

C. Approval of the Special Event Application from Ferndale Laboratories, Inc., for a Company Picnic on Saturday, August 23, 2003, at Garbutt Park, as submitted by City Clerk.

D. REMOVED FROM CONSENT-MOVED TO END OF REGULAR AGENDA

E. Approval of Cost Agreements with the Michigan Department of Transportation for traffic signal control for Eight Mile Road at Gardendale, Livernois and Pinecrest; and authorization for the Mayor and City Clerk to sign Agreements, as submitted by DPW Director.

F. Approval to schedule a Public Hearing on Monday, August 25, 2003, at 7:30 p.m., regarding Brownfield Plan for the property located at 1300 East Nine Mile Road, as submitted by CDS Director.

G. Approval of contracts with Robert Leets (DJ Bob Steel), The Viceroys and Jack Scott and Band for engagement at the Ferndale Woodward Dream Cruise Car Show on Saturday, August 16, 2003; authorization for the Mayor and City Clerk to sign contracts and authorization of payment, as submitted by Car Show Event Director.

H. Receive the Police Department Report for June, 2003.

I. Approval of the bills, payrolls (as certified by City Manager), to be paid subject to review by the Council Finance Committee.

XXX. Moved by Councilman Covey, seconded by Councilwoman Weber, to rename the Handicapper Advisory Committee to the Disability Advisory Committee.

B. Appointments to the Disability Advisory Committee

XXX. Moved by Councilman Covey, seconded by Councilwoman Weber, to appoint Rhonda R. Shegog, 415 Withington and Monica Mills, 275 W. Breckenridge to the Disability Advisory Committee.

C. Appointment to City Manager Informal Review Committee

XXX. Moved by Councilwoman Weber, seconded by Councilman Galloway, to appoint Councilman Joseph Trice to the City Manager Informal Review Committee.

D. Consideration to fill Fire Inspector position

XXX. Moved by Councilman Covey, seconded by Councilman Galloway, that the City Council authorize the Fire Department Chief to begin the testing and promotional process to fill the position Fire Inspector position.

E. Consideration of Street and Parking Lot Closures for Woodward Dream Cruise Car Show

Mayor Porter left Council Chambers at 9:41 p.m.

Mayor Porter returned to Council Chambers at 9:47 p.m.

XXX. Moved by Councilman Galloway, seconded by Councilwoman Weber, to approve the following closing as requested by the Car Show Executive Director Ken Miller, as follows:

West Nine Mile Road: from Woodward to Allen and West Nine Mile Road on Street Parking from Woodward to Allen from 3:00 a.m., Friday, August 15, 2003 until 12:01 a.m. Sunday, August 17, 2003;

Allen: from West Nine Mile to West Troy from 3:00 a.m., Friday, August 15, 2003 until 12:01 a.m. Sunday, August 17, 2003;

West Troy: from 3:00 a.m., Friday, August 15, 2003 until 12:01 a.m. Sunday,

August 17, 2003;

West Troy Street Parking Lot: from 3:00 a.m., Friday, August 15, 2003 until

12:01 a.m. Sunday, August 17, 2003 with reserving the southern most row in the Troy Street Lot for parking for the Central Business District and their customers

and that the Cruise Committee provided access to Troy Street for business deliveries on Friday August 15, 2003 and nothing in this Street and Parking Lot Closures related to the 2003 Woodward Dream Cruise and Ferndale Car Show and the Mustang Alley shall prohibited the re-opening of any of the closure if reopenings are agreed upon and coordinated by the Executive Director of the Ferndale Car Show, Police Chief and the DPW Superintendent or if deemed if necessary by the Police Chief.

Consent Agenda Item D - Authorization for the City Clerk to publish the mosquito control spraying legal notice in the Daily Tribune and Mirror, upon review of the City Attorney, as submitted by City Manager.

XXX. Moved by Councilman Trice, seconded by Councilwoman Weber, to table this item indefinitely until an action threshold of Level 3 condition as outline in the Integrated Pest Management Plan

XXX. City Clerk Pedro announced that Nominating Petitions are available in the City Clerk’s Office for those interested in running for Council or Mayor and the deadline to submitted petition is August 5, 2003, at 4:00 p.m.

XXX. Moved by Councilwoman Weber, seconded by Councilman Galloway, to approve the emergency repair of Vehicle No. 1270, Leach Sanicruiser Trash Truck in the amount of $4,012.75, to be charged to the Sanitation Fund, Repair and Maintenance, Account# 225-775.

XXX. Moved by Councilman Galloway, seconded by Councilwoman Weber, to approve that Aielli Construction be award the emergency water main repair at Wanda and Silman and that the $18,400 expense be charged to Account# 592-977, Water, Capital.

XXX. Councilman Galloway inquired if the Highway Committee had met regarding a way to help those on a corner lot with Sidewalk Repair fees and announced that the Friends of the Ferndale Library will be selling ice cream in front of the Library during the Dream Cruise to raise money for the library and are in need of volunteers to help sell the ice cream.

XXX. Councilwoman Weber announced a program at St. Mary’s Church in Royal Oak to commemorate the bombing of Hiroshima on Sunday, August 3, 2003, at 7:00 p.m.

XXX. Councilman Trice acknowledge the contribution of the DPW for the Dream Cruise; inquired about the status of free parking spaces for the library; inquired about a rebate from the from the City of Detroit for being overcharged water rates.

XXX. Councilman Covey requested the City Attorney or City Manager to check on the status of the Pond Ordinance; commented on the success of the Pub Crawl; a fund-raiser will be held in honor of fallen Police Officer Jessica Nagle-Wilson at the Hazel Park Bowl on August 15, 2003; requested the creation of an Ad-Hoc Committee for ways to honor the Lennon family be on the August 11, 2003 Agenda and requested that everyone be respectful of everyone during the political season and discuss the issues and not attack or criticize other candidates and their parties.

XXX. Mayor Porter commented on the success of the Pub Crawl and commended Councilman Covey for his efforts for the Pub Crawl and announced that Bob Hope had passed away today at the age of 100.

Mayor Porter adjourned the meeting at 11:24 p.m.
