FERNDALE CITY COUNCIL MEETING
MONDAY, NOVEMBER 24, 2003, 7:30 P.M. AT CITY HALL
A Regular Meeting of the Ferndale City Council was
held Monday, November 24, 2003, at City Hall, 300 East Nine Mile
Road, Ferndale. Mayor Porter called the meeting to order at 7:31
p.m.
Mayor Porter led the Pledge of Allegiance.
Roll call showed the following members of Council
present: Council Members Covey, Galloway, Weber; Mayor Porter.
Absent: Councilman Trice.

Councilman Galloway, to excuse Councilman Trice from this meeting.

PRESENTATION Street Signs to the City and the
Library from the Friends of the Library
XXX. Kevin Deegan Kruse and Councilman Galloway,
on behalf of the Friends of the Library, presented street signs to
the City and the Library, which would direct the public to the
Ferndale Library.
XXX. Call to Audience
1. Jean Davis, on behalf of the Arts and Cultural
Commission, announced that there would be a silent auction held on
Sunday, December 14, 2003, from 2:00 to
3:00 p.m., at the Kulick Community Center. She
indicated that the auction items were donations from the artists who
participated in the 2003 Art Fair.
2. Francine Hachem, on behalf of the Arts and
Cultural Commission, announced the names of two people who would be
awarded scholarships by the Commission. She also announced that
auditions for the upcoming performance of the Youth Theater,
"Good and Plenty Players" would be held on Saturday,
December 20, 2003, at 11:00 a.m., at the Kulick Community Center.
Consent Agenda
XXX. Moved by Councilman Covey, seconded by
Councilman Galloway, to approve the Consent Agenda as submitted:
A. Approval of the Minutes of the Special Meetings
held September 22, and October 13, 2003, and the Regular Meetings
held September 22 and
October 13, 2003, as submitted by City Clerk.
B. Adoption of Year 2004 City Boards and Commissions
meeting calendar, as submitted by City Manager.
C. Approval of the contract with SMART for the
Specialized Services Operating Assistance Program Third-Party
Contract for the period covering October 1, 2003 to September 30,
2004, and authorization for the Mayor and City Clerk to sign the
Contract, as submitted by Recreation Director.
D. Approval of the bills, payrolls (as certified by
City Manager) to be paid subject to review by the Council Finance
Committee.

Councilman Covey, to appoint Jeffrey Sharpe, 2271 Pinecrest, to fill
the unexpired term of Jim Moll, expiring December 31, 2004.

B. Consideration of Howe’s Bayou’s request for
Sidewalk Cafe application and parking modifications on Woodward
XXX. Moved by Councilman Galloway, seconded by
Councilman Covey, to approve the request for Sidewalk
Cafe application and parking modifications on Woodward, as detailed
on the Sidewalk Café proposal, contingent upon MDOT approval for
the changes to the parking bays along Woodward and also contingent
upon negotiation of a License Agreement with Howe’s Bayou where
they would bear the cost for these modifications and subject to
review by the City Attorney.

Act of 2003

Councilwoman Weber, to adopt the Resolution regarding the Internet
Tax Non-Discrimination Act of 2003.

D. Consideration of Resolution regarding the
importation of prescriptions from Canada
XXX. Moved by Councilman Galloway, seconded by
Councilwoman Weber, to adopt the Resolution regarding importation of
prescriptions from Canada with corrections made at the table.

E. Update on Holiday Displays
Council took no action on this Agenda Item.
F. Consideration to select an official newspaper for
publications of local City legal and general advertising for the
remainder of FYE 2004, FYE 2005 and FYE 2006
XXX. Moved by Councilman Covey, seconded by
Councilwoman Weber, to select The Daily Tribune and/or The
Mirror as the official newspapers for publications of local City
legal and general advertising, at the discretion of the City
Departments based on the needs for that particular item, for the
remainder of FYE 2004, FYE 2005 and FYE 2006 at a quote cost of
ninety cents (.90) for The Mirror, seventy-five cents (.75)
per line for The Daily Tribune, per the information
submitted by the newspapers.

G. Consideration of METRO Act unilateral
right-of-way telecommunications permit with SBC for an installation
at Huron and the I-696 Service Drive
XXX. Moved by Councilwoman Weber, seconded by
Councilman Covey, to approve the METRO Act unilateral right-of-way
telecommunications permit with SBC for an installation at Huron and
I-696 Service Drive and to authorize the Mayor to sign the
agreement, with the addition of the name of the City of Ferndale be
placed on the telecommunications permit and the date of signature
and reference the term of five years as in Section 7.1.1, which
instead of "five years or less" in parentheses should say
"five years".

H. Consideration of Resolution regarding 2004
Woodward Dream Cruise and appointment of representatives to the
Liaison Board
XXX. Moved by Councilman Covey, seconded by
Councilwoman Weber, that City Council approves the Resolution
stating the City’s intent to participate in the 2004 Woodward
Dream Cruise event and appoint Marsha Mellert its Liaison and Ken
Miller its alternate liaison to the WDC, Inc.TM Liaison
Board for the 2004 event.

Moved by Councilman Galloway, seconded by
Councilwoman Weber, for a monetary donation to the Ferndale

Call to Council
XXX. Police Chief Kitchen wished everyone a
Happy Thanksgiving and to have a safe Holiday Season.
XXX. Fire Chief LeGault wished everyone a Happy
Thanksgiving and announced that the Goodfellows Paper Sale would be
held on Friday, December 5, 2003.
XXX. City Manager Barwin wished everyone a Happy
Thanksgiving, thanked all on Council who have attended a variety of
meetings and special events over the past couple of weeks and
commented that Andy Meisner was working to help the City in Lansing
and keeping the City briefed.
XXX. City Attorney Christ commented on a lawsuit
filed against Lanzo Lining and that the Defendant has elected to pay
the full amount of the claim.
XXX. City Clerk Pedro wished everyone a Happy
Thanksgiving.
XXX. Councilman Galloway announced that the
Library Book Sale Preview Night held recently was a success and
thanked all the businesses that donated and the volunteers that
worked at the event. He also announced that the Friends of the
Library Board meets the second Tuesday of the month at 6:30 p.m., at
the Library.
XXX. Councilwoman Weber commented on the SMART
contract, which was approved at this meeting, regarding
transportation and suggested that a staff member may want to make a
presentation at a future Council Meeting to provide information to
the public on this service. She wished everyone a Happy Thanksgiving
and indicated that it was President Abraham Lincoln who proclaimed
Thanksgiving as a national holiday in 1863.

unanimously, to adopt the Resolution regarding Civil Liberties.

XXX. Councilman Covey congratulated local
business owner, Thomas Pearlman, on being named "Businessman of
the Year" by the Ferndale Chamber of Commerce. He announced
that the club owned by Posh Entertainment should be opening soon;
the next Blues Festival Organizing Committee meeting would be held
Tuesday, December 2, 2003, at 7:30 p.m., at Tony’s Sports Bar, the
Blues Festival is set for January 28, 29, 30, and 31, 2004, and
