PROPOSED MINUTES

FERNDALE CITY COUNCIL MEETING

TUESDAY, DECEMEBER 27, 2005, 7:30 P.M. AT CITY HALL

A Regular Meeting of the Ferndale City Council was held Tuesday, December 27, 2005, at City Hall, 300 East Nine Mile Road, Ferndale. Mayor Porter called the meeting to order at 7:32 p.m.

Mayor Porter led the Pledge of Allegiance.

Roll call showed the following members of Council present: Council Members Covey, Galloway, Lennon, Weber; Mayor Porter. Absent: None.

XXX. Mayor Porter asked to address a few items prior to the beginning of the meeting, if no Council Members objected. Mayor Porter introduced Roger Schmidt as the new permanent Fire Chief and he recognized Councilwoman Weber for her years of services.

XXX. Moved by Mayor Porter, supported unanimously, to adopt the Resolution recognizing Councilwoman Weber for her years of dedicated services to the City of Ferndale.

ADOPTED UNANIMOUSLY

PRESENTATION Ferndale Chamber of Commerce

XXX. Bill Axtell, of the Ferndale Chamber of Commerce, provided information regarding the activities of the Ferndale Chamber of Commerce.

PUBLIC HEARING Transfer of Class C Liquor License with Entertainment Permit to be located at 22914 Woodward

XXX. Mayor Porter opened the Public Hearing at 7:42 p.m., regarding the transfer of a Class C Liquor License to be located at 22914 Woodward. Jeremy Haberman indicated objection to the transfer of Tavern License and transfer classification to a Class C License. Michael Hennis had comments and/or questions. Mayor Porter closed the Public Hearing at 8:02 p.m.

A. Consideration of Resolution regarding transfer of Class C Liquor License with Entertainment Permit to be located at 22914 Woodward

Mayor Porter left Council Chambers at 8:14 p.m.

Mayor Pro Tem Covey assumed the Chair.

Mayor Porter returned to Council Chambers at 8:18 p.m.

XXX. Moved by Councilman Lennon, seconded by Councilman Covey, to approve the LLC Class C Transfer Resolution with Entertainment Permit from Chef Mark, Inc., located in Ortonville, Michigan, to the Sakana Sushi Lounge, G & K Restaurant Enterprises, L.L.C., located at 22914 Woodward, with the understanding that Sakana Sushi Lounge will take pro-active measures to establish and continue a parking information effort to direct patrons to municipal and private parking lots, and most importantly discouraging customers from parking in residential neighborhoods.

Moved by Councilman Lennon, seconded by Councilman Covey, to adopt the findings of fact from the Review Committee, as submitted in the memo from the City Manager dated December 19, 2005.

AMENDMENT TO THE MOTION CARRIED

XXX. Moved by Councilman Covey, seconded by Councilwoman Weber to send the issue of moratorium on Liquor Licenses to the Ordinance Committee to return back to Council to the Regular Council Meeting of January 23, 2006.

XXX. Call to Audience

1. Steve Kuzmanovich, member of the Civil Service Board, commented on the process of hiring a Fire Chief.

2. Maurice Geary commented on Councilwoman Weber’s service to the community.

3. Mark McConnell inquired about sidewalk snow removal and an increase in water rates.

Councilman Galloway left Council Chambers at 8:56 p.m.

Consent Agenda

XXX. Moved by Councilwoman Weber, seconded by Councilman Covey, to approve the Consent Agenda, as submitted.

A. Approval of Second Hand/Junk Dealer Application/License for Blockbuster, Inc., to sell used videos, as submitted by City Clerk.

B. Adoption of Resolution regarding 2006 Woodward Dream Cruise and appointment of representatives to the Liaison Board, as submitted by the DDA Manager.

C. Approval of the bills, payrolls (as certified by City Manager), to be paid subject to review by the Council Finance Committee.

A. Consideration to test and fill Fire Captain and subsequent Fire Lieutenant, and Fire Sergeant positions

XXX. Moved by Councilwoman Weber, seconded by Councilman Lennon, to authorize Fire Chief Schmidt to fill the vacant Captain position and any subsequent lower ranks.

B. Consideration of adoption of Ordinance No. 1003, which amends Chapter 7, Business Regulation and Licenses Generally, Article VI, Business Registration, of the Ferndale Code of Ordinances

XXX. Moved by Councilman Lennon, seconded by Councilwoman Weber to adopt Ordinance No. 1003 which amends Chapter 7, Business Regulation and Licenses Generally, Article VI, Business Registration, of the Ferndale Code of Ordinances with the following changes: deletion of Section 7-116; and change the expiration date in Section 7-113 from December 31st to January 31st.

C. Consideration of approval of contract between the City and Ferndale School District for payment of School Resource Officer

XXX. Moved by Councilman Lennon, seconded by Councilman Covey, to approve the contract between the City and Ferndale School District for payment of School Resource Officer.

Consideration of Temporary Liquor License for the Blues Festival

XXX. Moved by Councilman Lennon, seconded by Councilwoman Weber, to approve the Temporary Liquor License for the Blues Festival contingent upon receipt of the proper insurance, lease agreement and related requests.

Call to Council

XXX. Police Chief Kitchen congratulated new Fire Chief Schmidt on his promotion. He wished everyone a Happy New Year and reminded the public to be safe when celebrating New Year’s. Chief Kitchen recognized Councilwoman Weber for her years of dedicated service to the City.

XXX. Fire Chief Schmidt thanked Council for his appointment and thanked Councilwoman Weber for her years of dedicated service to the City. He reminded the public to be safe when celebrating New Year’s.

XXX. City Manager Barwin announced that trash collection will be collected as regularly scheduled this week, but next week it will be delayed one day. He congratulated Fire Chief Schmidt on his appointment and recognized Councilwoman Weber for her years of dedicated service to the City.

XXX. City Clerk Pedro wished everyone Happy Holidays and recognized Councilwoman Weber for her years of dedicated service to the City.

XXX. City Attorney Christ wished everyone Happy Holidays and recognized Councilwoman Weber for her years of dedicated service to the City.

XXX. Councilman Lennon congratulated Fire Chief Schmidt on his appointment; wished everyone Happy Holidays; and recognized Councilwoman Weber for her years of dedicated service to the City.

XXX. Councilman Covey recognized Councilwoman Weber for her years of dedicated service to the City. He indicated that the Ordinance Committee had not completed research on Travel Expenses for Council but that a form would need to be created for Council to complete to be reimbursed on mileage, parking and telephone calls. Councilman Covey commented on an article regarding disability accessibility that appeared in a local newspaper. He wished everyone Happy Holidays.

XXX. Councilwoman Weber commented on her experience as a Council Member.

XXX. Mayor Porter commented on a newspaper article that addressed a lack of money that Cities were receiving from the State. He congratulated new Fire Chief Schmidt on his promotion and recognized Councilwoman Weber for her years of dedicated service to the City. Mayor Porter wished everyone Happy Holidays.

Mayor Porter adjourned the meeting at 9:42 p.m.
