FERNDALE CITY COUNCIL MEETING
Monday, May 11, 2009

A Regular Meeting of the Ferndale City Council was held Monday, May 11, 2009 at City Hall, 300 East Nine Mile Road, Ferndale. Mayor Covey called the meeting to order at 7:32 p.m.

Absent: None

3. APPROVAL OF AGENDA

184. Moved by Gumbleton, seconded by Baker, to approve the agenda as submitted.

AYES: Council Members Baker, Galloway, Gumbleton, Lennon, Mayor Covey

NAYS: None

MOTION CARRIED

4. PRESENTATIONS

A. Poppy Week

185. Moved by Covey, supported unanimously, to adopt the Resolution proclaiming May 18 – 23, 2009 as Poppy Week in the City of Ferndale.

MOTION CARRIED UNANIMOUSLY

B. Ferndale Public Schools

Jessica Scott-Stilger, Communication Specialist, provided an update on the activities and accomplishments of students in the Ferndale school district.

C. Environmental Impact Commission (EIC) – Annual Green Awards

Jay Schloff and Deb Olsen presented the Residential Environmental Leader Award to Becky Hammond and the Business Environmental Leader Award to Affirmations.

5. CALL TO AUDIENCE

Lynna Kauchek, EIC, announced a monthly seminar program, to be held on the second Tuesday of each month, 6:30 p.m. – 7:30 p.m. at the Kulick Center. May’s topic will be composting.

Ann Heler, Board President of FernCare, announced two upcoming fundraising events.

Julie Glazier, Publicity Chair for Ferndale Youth Assistance, reported on the status of upcoming camps. Ms. Glazier also noted several winners at the recent FYA Awards Recognition night and announced upcoming fundraising events.

Larry Saville, Michigan’s Fallen, announced this year’s walk is in need of volunteers.

Greg Pawlica announced the beginning of a "Slow Zone" campaign on East Saratoga, between Woodward and Paxton.

Joe Mahan shared his thoughts on Ferndale’s positive attributes, and asked that the City do something about insurance companies’ practice of redlining Ferndale.

Frank Flores, American Legion, thanked the Ferndale Elks for honoring active soldiers and veterans last Wednesday.

Councilman Lennon left Council Chambers at 8:06 p.m.

6. CONSENT AGENDA

186. Moved by Galloway, seconded by Baker, to approve the Consent Agenda as submitted:

A. Approved the following minutes: 1) Special Meeting of April 27, 2009; 2) Regular Meeting of April 27, 2009; 3) Special Meeting of April 28, 2009; 4) Special Meeting of May 4, 2009; 5) Special Meeting of May 6, 2009.

B. Confirmed the reappointments of Greg Pawlica and Aaron Retish to the Police and Fire Board for terms ending May 2010.

C. Approved the License Agreement with Buffalo Wild Wings and authorized the Mayor and the City Clerk to sign the Agreement.

D. Authorized the Mayor to sign the Letter of Support for the Planning Commission’s application to the American Planning Association for a Planning Excellence Award.

E. Adopted the Resolution proclaiming April 24, 2009 as Arbor Day in the City of Ferndale.

F. Approved the bills and payrolls as certified by City Manager to be paid subject to review by the Council Finance Committee.

Councilman Lennon returned to Council Chambers at 8:08 p.m.

7. REGULAR AGENDA

A. Consideration of Resolution recognizing former Deputy Clerk Sharon Szalma.

187. Moved by Mayor Covey, supported unanimously, to adopt the Resolution of recognition for former Deputy Clerk Sharon Szalma on her retirement.

MOTION CARRIED UNANIMOUSLY

B. Consideration of Motor City Pride Sponsorship.

188. Moved by Lennon, seconded by Baker, to table consideration of sponsoring Motor City Pride until May 26, 2009.

AYES: Council Members Galloway, Gumbleton, Lennon, Baker, Mayor Covey

NAYS: None

MOTION CARRIED

Mayor Covey left Council Chambers at 8:23 p.m. and relinquished the Chair to Mayor Pro Tem Galloway. Mayor Covey returned to Council Chambers at 8:25 p.m. and resumed the Chair.

C. Consideration of Intergovernmental Agreement for the Edward Byrne Justice Assistance Grant (JAG).

189. Moved by Baker, seconded by Gumbleton, to approve the proposed intergovernmental agreement between the City of Ferndale and Oakland County regarding the submission of a joint grant application.

D. Consideration of request to fill Deputy City Clerk position and to revise the salary and wage plan.

190. Moved by Gumbleton, seconded by Galloway, to authorize the City Clerk to fill the Deputy City Clerk position and to adopt the revised salary and wage plan, with a minimum/maximum range of $41,135 - $50,000, for the Deputy City Clerk position as presented.

NAYS: None

E. Consideration of Pimp Your Pot Event.

191. Moved by Baker, seconded by Lennon, to approve the Ferndale DDA to host the Pimp Your Pot event on May 30, 2009, including merchant sidewalk sales all day and Planavon Street and Planavon Parking Lot closure from 7am - 1pm.

192. Moved by Baker, seconded by Gumbleton, to amend the motion to direct the DDA to continue moving forward with the event but to also work with the City Attorney to develop guidelines to protect the public’s health and safety.

8. COUNCIL LIAISON REPORTS

A. 8 Mile Blvd. Association (8MBA). City Manager Bruner announced the leadership luncheon will be held on Friday.

B. Michigan Suburbs Alliance (MSA). Councilwoman Baker announced the Millennial Mayor’s Congress kickoff is June 5, 4:30 p.m. – 7:00 p.m.

C. South Oakland County Mayors Association (SOCMA). Mayor Covey announced the next meeting will be held in Southfield.

9. CALL TO COUNCIL

193. Chief of Police Kitchen announced the Police Memorial ceremony will take place on Wednesday at 10:00 a.m. He also noted crime statistics are down for the first four months of the year.

194. City Manager Bruner reported Marsha Scheer was honored as City Worker of the Year, and that the City is receiving a $100,000 Brownfield grant due to Ms. Scheer’s efforts. Mr. Bruner asked Council members to turn in their budget binders so the pages may be replaced with the adopted budget.

195. Councilman Lennon announced the Ferndale scavenger hunt hosted by New Way Bar has been rescheduled.

196. Councilwoman Gumbleton noted non-profit entities may submit grant applications to the Ferndale Community Foundation until 5:00 p.m., May 22.

197. Councilman Galloway congratulated Dave Bing on his victory in the Detroit mayoral election and expressed hope for the success of Detroit and its surrounding communities. Councilman Galloway noted that for the eighth time in his eight-year tenure on Council a balanced budget has been adopted.

198. Mayor Covey announced the State of the City Address, sponsored by the Chamber of Commerce, takes place on Thursday at Via Nove.

10. ADJOURNMENT

There being no objections, Mayor Covey adjourned the meeting at 9:00 p.m.
