CITY COUNCIL MEETING

Monday, December 28, 2009

A Regular Meeting of the Ferndale City Council was held Monday, December 28, 2009 at City Hall, 300 East Nine Mile Road, Ferndale. Mayor Covey called the meeting to order at 7:30 p.m.

Present: Mayor Covey, Council Members Baker, Galloway, Gumbleton, Lennon

Absent: None

3. APPROVAL OF AGENDA

388. Moved by Council Member Baker, seconded by Council Member Gumbleton, to approve the agenda as submitted.

AYES: Council Members Baker, Galloway, Gumbleton, Lennon, Mayor Covey

NAYS: None

MOTION CARRIED

4. PRESENTATION

A. Resolution of Appreciation for Council Member Gumbleton.

389. Moved by Council Member Galloway, supported unanimously, to adopt the Resolution expressing appreciation for Council Member Gumbleton’s years of service.

AYES: All

NAYS: None

MOTION CARRIED

5. CALL TO AUDIENCE

Frank Flores, American Legion, noted the highlights of the Legion's history in Ferndale.

Sherry Wells registered complaints about the noise from Rosie's O’Gradys.

Wyll Lewis provided a report from the Nine Mile Merchants.

6. CONSENT AGENDA

390. Moved by Council Member Lennon, seconded by Council Member Baker, to approve the consent agenda as submitted:

Approved the Minutes of the Special Meeting held December 7, 2009, and the Regular Meeting held December 14, 2009.

Adopted Resolution Opposing School Funding Cuts.

Confirmed re-appointment of Michael Hennes to the DDA Board of Directors for a term expiring December, 2013.

Approved a Special Event Permit as requested by Mr. Dean Bach for the Blue BQ Rib Burn Out III to be held in the Ferndale Public Library parking lot on Saturday, February 6, 2010, from 12:00 noon until 9:00 p.m., contingent upon:

Applicant placing signs to direct patrons to the City Hall and East Breckenridge parking lots.

The Fire Department receiving and approving a detailed layout plan of the tent, including specifications and placement of tent heaters.

Applicant’s liability insurance certificate being approved by the City Attorney.

The applicant obtaining a tent permit and an operational permit

The applicant paying the $400 application fee.

Approval of the Second Amendment to the Neighborhood Stabilization Program Contract with Home Renewal Systems of Michigan LLC for a revised total contract amount of $1,223,063.

Approved entering into two Code Enforcement employment contracts with the selected screened candidates subject to background checks and final negotiations, to be charged to account # 280-805.

G. Approved the bills and payrolls as certified by City Manager to be paid subject to review by the Council Finance Committee.

7. REGULAR AGENDA

A. Appointment of Jacki Smith to the DDA Board of Directors

391. Moved by Council Member Baker, seconded by Council Member Galloway, to confirm the appointment of Jacki Smith of Candle Wick Shop to the Ferndale DDA Board of Directors with a term expiring December 2013.

AYES: Council Members Lennon, Baker, Galloway, Gumbleton, Mayor Covey

NAYS: None
MOTION CARRIED

Council Member Lennon left Council Chambers at 8:02 p.m. and returned at 8:04 p.m.

B. Consideration of Special Event Application and Policy Revisions

392. Moved by Council Member Galloway, seconded by Council Member Lennon, to adopt Items 7 -21, except Item 13 and Item 18, of the proposed changes to the Special Event Application and Policy as presented by the City Clerk.

AYES: Council Members Baker, Galloway, Gumbleton, Lennon, Mayor Covey

NAYS: None

MOTION CARRIED

393. Moved by Council Member Gumbleton, seconded by Council Member Galloway to table until January 11, 2010, Items 1 - 6 of the proposed changes to the Special Event Application and Policy as presented by the City Clerk and review all Special Event fees at that time.

AYES: Council Members Galloway, Gumbleton, Lennon, Baker, Mayor Covey

NAYS: None

8. COUNCIL LIAISON REPORTS:

B. Michigan Suburbs Alliance (MSA) – Councilwoman-elect Piana announced the possibility of MSA receiving a significant federal grant.

9. CALL TO COUNCIL

Chief of Police Kitchen announced an arrest has been made in the VFW murder case and issued thanks to all the agencies which assisted.

City Manage Bruner acknowledged the work of Cable Director Schmidt, City Clerk Tallman and Deputy Clerk McGrath in implanting the live streaming of council meetings on the internet.

Councilwoman Baker announced that the Fern Care construction plan is rapidly moving forward.

Councilman Lennon thanked the Police Department for their investigation of the murder case and commended the Fire Department for their rescue of a woman from a burning building in Hazel Park.

Councilwoman Gumbleton thanked the citizens who elected her and commended the City Council and City Staff for their professionalism. She congratulated Councilwoman-elect Piana and commended her dedication.

Council Members and City Staff voiced their appreciation of Councilwoman Gumbleton’s hard work and dedication, and wished her well in her future endeavors.

Mayor Covey commented the DDA on the success of the recent Ice Festival, thanked Dean Bach for his ice jungle and announced the upcoming Blues Festival.

10. ADJOURNMENT

There being no objections, Mayor Covey adjourned the meeting at 9:25 p.m.
